Terms and Conditions

Please read the following carefully.

Vurie Adventures is a trading name of Devotion2motion.com Limited hereinafter referred to as “we, us, our or the company”.

1. Your Holiday Contract Law & Jurisdiction

A contract will exist once we acknowledge receipt of your deposit following the submission of your booking. This contract is made on the terms of these booking conditions, which are governed by Scottish, UK & EU Law, and the jurisdiction of the Scottish Courts. You may however, choose the law and jurisdiction of England or Northern Ireland if you wish to do so.

2. Your Financial Protection

The 1990 EU Package Travel Directive transposed into UK law as The Package Travel, Package Holidays and Package Tours Regulations 1992 require us to provide security for the monies that you pay for the package holidays booked from us. All monies paid to us are held in a trust account administered by a regulated body.

3. Booking your holiday

To make a booking you must be 18 or over and guarantee that you have the legal authority to accept and do accept on behalf of your party the terms of these booking conditions. You must submit a completed booking form and a non-refundable deposit for each person, either by instructing one of our representatives over the telephone, electronically via our website or by post. Each booking form submitted by you will be treated as an offer to purchase the holiday package in accordance with these terms and conditions. We will acknowledge receipt of your booking by e-mail. If you notice any errors regarding your booking on this e-mail, please contact us at booking@vurie.com or by telephone on 01786 497250 to correct these. A contract will be in place between us (all persons named on the booking form) once your deposit has cleared and we have issued a confirmation of this. The date on the confirmation will be the date the contract is made.

4. Conditions of booking

4.1 All clients must agree to these terms and conditions.
4.2 All clients must have adequate and valid insurance in place covering the duration of your holiday. You are required to carry proof of this while on holiday and will be asked to agree to have this in place at the time of booking.
4.3 All clients are expected to satisfy themselves prior to booking that they are fit and able to complete the itinerary of their chosen holiday as described on our website.
4.4 We welcome anyone suffering from mobility impairment, illness or disability or undergoing treatment for any physical or medical condition. It’s important that you declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment which may be required during the holiday. Failure to make such disclosure will constitute a breach of these terms and conditions and may result in such persons being excluded from the holiday in which case all monies paid will be forfeit.

5. Special Requests

At the time of booking you will be asked if you have any special requests. We will advise if these can be accommodated and if there is a charge for them. Dietary requirements can often be accommodated at no cost but cannot be guaranteed unless we are aware of them before you travel. It is important that you make us aware of these at the time of booking.

6. Your Behaviour and Responsibility

All clients are expected to behave in a reasonable and responsible manner while on holiday. You are expected to take care of any equipment rented out to you including bicycles, accessories and accommodation. Do not drop litter in the countryside or street. Dispose of it properly in a bin and if no bin is nearby hold onto it by keeping it in your bag until you find one. Ride with due care and attention. Do not ride a bicycle while under the influence of alcohol or drugs. Show consideration to other route users including walkers, cyclists and motorised vehicles. Respect your accommodation hosts and other guests. You should not be noisy or disruptive at night or during the day. Offensive, aggressive or threatening behaviour will not be tolerated and may result in your holiday being terminated without compensation. Anyone behaving erratically or irrationally or suspected of being under the influence of alcohol or drugs may not be permitted access to accommodation or transfer vehicles and we reserve the right to withhold bicycles. In extreme cases your holiday may be terminated without compensation.

7. Provision of Equipment

7.1 Equipment including bicycles and accessories provided by us are let out on hire to you. All equipment is properly maintained and checked before leaving the workshop.
7.2 With bicycles we will provide as standard: helmets; pumps; puncture repair kit; spare inner tube. Most bicycles have one bottle holder attachment but some have two. Panier racks and packs are additional items that if required shall incur a separate charge.
7.3 Our bicycles are fitted with standard flat platform pedals and we do not provide clipless pedals. However we can fit toe clip with strap. You are welcome to bring your own pedals but these must be fitted by our member of staff.
7.2 You are responsible for any equipment given to you under the terms of the holiday contract. You must ensure that it is not damaged in any way and is returned to us in the same condition that you received it other than what would be deemed reasonable wear and tear. You will be charged for equipment that is returned damaged.
7.3 You must take all reasonable precautions to ensure the equipment is secured when not in use. In the event of loss or theft of the equipment we reserve the right to levy a charge against you for the value of the equipment. This amount will not be less than £300.00 and no more than £1500.00.
7.4 You are strongly advised to check your equipment for defects each day before use to ensure that it is still in good working order. It is not unusual for fittings to become loose following use.

8. Bringing Your Own Equipment

You are welcome to bring your own equipment but are responsible for making sure it is in good working order and suitable for undertaking the holiday you have booked. If you own your own helmet we recommend you bring it although we do provide helmets as standard with bicycles provided by us. You may also bring your own pedals but you cannot fit them to a bicycle provided by us. This must be done by one of our staff members. Fitting them yourself would be a breach of these terms and conditions.

9. Your Holiday Accommodation

All accommodation arranged for you by us must only be used by those persons named on the final invoice. You are not allowed to share the accommodation or let anyone else stay there. You are liable for the cost of putting right any damage caused to your accommodation or its contents during your stay and the accommodation proprietors may seek payment from you before you leave.

10. Your Holiday Price

The price quoted on our website or other marketing material is to serve as a guide price only. The price of your holiday will be calculated at the time of booking. You will be made fully aware of the price at the time of booking. By proceeding with your booking you agree to the price and thereafter to be bound by these terms and conditions.

11. Changing or Cancelling your Holiday Booking

11.1 You must advise us in writing of any changes you wish to make to your booking.
11.2 Transfer your Booking
11.2.1 If you are unable to travel you may transfer your booking to another person provided they meet and agree to these terms and conditions.
11.2.2 An administration charge of £50.00 will be charged for transferring your booking.
11.3 Changing Part or all of your Booking
11.3.1 You are allowed to change the type of bike you wish once free of charge subject to availability. If you request a different bike more than once you will incur an administration charge of £20 for each bike changed.
11.3.2 If you wish to alter part of your booking we will try to make the alteration on your behalf subject to availability. Each change made will incur a £50.00 alteration fee.
11.3.3 If you wish to book a different holiday or alter the dates of your holiday we will try to make the alterations subject to availability. If the new holiday booking would incur a higher charge than your original booking then you will be asked to pay a higher deposit on top of a £50.00 administration fee.
11.4 Cancelling your Booking
11.4.1 We reserve the right to cancel or alter your booking at any time. If we do so you will be advised of the changes and have the following options:

(i) accept the changes we make or,
(ii) accept another holiday offered to you or,
(iii) cancel your holiday in which case a full refund shall be made to you.

11.4.1.1 The following are reasons we may cancel your booking:

(i) Your failure to pay your deposit or settle a due balance.
(ii) Force majeure. That is any event which we or a supplier of services could not even with all due care, foresee or forestall such as (by way of example and not by way of limitation) war, threat of war, riots, civil disturbances, industrial disputes, actual or threatened terrorist activity and its consequences, natural or nuclear disaster, fire, epidemics, health risks and pandemics, acts of God, actual or potential adverse weather conditions, and any other similar events.

11.4.2 You may cancel your booking at any time. Doing so will incur the following charges:

(i) More than 56 days before departure – loss of deposit
(ii) Between 28 and 56 days before departure – 50% of holiday cost.
(iii) Between 14 and 28 days before departure – 80% of holiday cost.
(iv) Less than 14 days before departure – 100% of holiday cost.

12. Your Holiday Description

The description of your holiday on our website is intended as a guide. Any information given is accurate to the best of our knowledge. Details of routes are accurate at time of writing but can be subject to change as a result of forestry works, road works or other unforeseen circumstances. In most cases we will be able to update you of any route alterations prior to departure and in most cases these alterations are likely to be minor. All bikes provided are of a good standard and more than sufficient for undertaking your proposed itinerary. If any bike provided by us proves deficient as a result of mechanical failure then once we have been informed we shall endeavour to supply you with a suitable replacement or make appropriate repairs to the bike. All accommodation is inspected by our staff. Most is graded by the national tourist board and complies with such standards. Where an accommodation is not part of the national tourist boards grading scheme we ensure that it has all the necessary safety policies in place and complies fully with regulations. We also inspect it for cleanliness and comfort.

13. Our Liability

13.1 Our obligations, and those of our suppliers providing any service or facility included in your holiday, are to take reasonable skill and care to arrange for the provision of such services and facilities. You must show that reasonable skill and care has not been used if you wish to make any claim. The suppliers of the services and facilities included in your holiday should comply with UK standards.
13.2 If any element of our contract with you is not properly performed or omitted by us or our suppliers we will pay you appropriate compensation if the enjoyment of your holiday has been spoiled as a result.
13.3 We will not be liable for:
13.3.1 any issues arising as a result of force majeure (see 10.4.1.1 (ii) above).
13.3.2 any services obtained through other parties that are not part of your package.
13.3.3 your actions or for any failure that is attributable to you such as failure to wear appropriate safety equipment.
13.3.4 injury as a result of you having an accident while riding a bike in any environment.
13.3.5 the theft of bicycles.
13.3.6 anything where the cause of the failure to provide, or failure in, your holiday or any death or personal injury you may suffer is not due to any fault on our part or that of our agents or suppliers, because it is either attributable to you, or attributable to someone unconnected with your holiday and is unforeseeable or unavoidable, or is due to unusual or unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised, or an event which neither we, nor our agents or suppliers could have foreseen or forestalled.
13.4 Although we may not be liable for a certain circumstance you find yourself in we shall at our discretion endeavour to assist you where we can.

14. Complaints

If you have any complaints about any element of your holiday then you must notify us or the service provider immediately. If you’re complaint relates to the accommodation you are staying in or another service providers’ service then please address your concern to the providers’ representative first. If their response is not satisfactory then please advise us in writing within 30 days of completion of your holiday. We will advise you of receipt of your complaint within 7 days and respond in full within 28 days. We aim to resolve all complaints. If we are unable to agree then you may wish to consider arbitration.

15. Payment of your Holiday

Full payment of your holiday must be received 56 days prior to your departure date.

16. Your Safety and Security

While on holiday you are responsible for your own safety and security and the safety and security of your personal belongings. You must ensure that you are properly attired prior to undertaking any activity. If you are unsure about what should be worn while partaking in an activity then please ask one of our staff members or one of our suppliers representatives for advice.
